Benefit-sharing agreements
To access biological resources for commercial or potentially commercial purposes, you must use a benefit-sharing agreement.
The benefit-sharing agreement must:
- use the model Benefit-sharing Agreement (Commonwealth areas) as the basis for the agreement. The requirement to use the model agreement only applies to Commonwealth areas.
- be attached to your permit application.
You must enter into the agreement with Access Providers. Access Providers are set out in the EPBC Regulations. We can help you identify the relevant Access Providers.
A benefit-sharing agreement only applies if the Minister for the Environment and Water issues a permit. The Minister will only issue a permit if satisfied the benefit-sharing agreement was made with the prior informed consent of the Access Providers.
